Spanish nationality through marriage is not automatic. An eligible spouse of a Spanish citizen can apply for nationality by residence after one year of qualifying legal residence in Spain, provided the marriage condition and the other requirements are met.
You must distinguish the residence period, the length of the marriage and the time needed to process the application. Completing one year does not mean you receive a Spanish passport immediately.
This guide explains eligibility, documents, exams, fees and the steps after approval. You can also explore Nodisea’s Spanish nationality service for help with your application.
1. The one-year rule: residence and marriage
Article 22 of the Civil Code allows the shortened residence period for someone who, at the time of applying, has been married to a Spanish citizen for one year and is not legally or factually separated.
Two conditions must therefore be satisfied:
| Condition | What you must establish |
|---|---|
| Qualifying residence | At least one year of legal, continuous residence in Spain immediately before applying |
| Marriage | At least one year married to a Spanish citizen when you apply, without legal or factual separation |
These periods can overlap. The rule does not require an additional year of residence after the first wedding anniversary.
For example, suppose you married a Spanish citizen on 10 January 2025 and your qualifying legal residence began on 20 March 2025. On those assumptions, both periods would be completed on 20 March 2026, provided residence remained continuous and the other conditions were met.
Before relying on this calculation, verify the effective dates in your own residence and marriage records.
2. Check whether your residence qualifies
The Ministry of Justice requires residence to be legal, continuous and immediately before the application. Good civic conduct and sufficient integration must also be established.
Do not calculate the year solely from your first arrival in Spain, your NIE number or the date you registered on the municipal padrón. Review the legal basis and effective dates of your residence status.
Prepare your residence decisions, identity documents and travel history. If there were gaps in your status or extended absences, have them assessed before choosing a filing date.
Marriage and nationality are also separate from permission to reside in Spain. For couples still planning their move, our guide to residence routes for non-EU partners explains the available immigration options.
3. Documents for Spanish nationality through marriage
The Ministry’s nationality checklist identifies general documents and additional evidence for applicants married to Spanish citizens.
For an adult applicant, prepare the following, subject to the rules on authorised official checks and your individual circumstances:
| Document or evidence | Purpose |
|---|---|
| Valid full passport | Identity, nationality and relevant travel history |
| TIE or applicable EU residence documentation | Residence status |
| Applicant’s birth certificate | Birth and personal details |
| Criminal record certificate from the country of origin | Evidence relevant to good civic conduct |
| Spanish spouse’s literal birth certificate from the Spanish Civil Registry | Evidence relating to the Spanish spouse |
| Literal marriage certificate from the Spanish Civil Registry | Proof of the marriage |
| Joint padrón or cohabitation certificate | Evidence of living together |
| Exam results or evidence of an applicable exemption or dispensation | Integration and language requirements |
| Proof of payment of the application fee | Payment of the nationality fee |
| Mandate or power of representation, where applicable | Authority for a representative to act |
Some Spanish records and exam results can be checked directly when you provide the appropriate consent. Do not assume that every record must be obtained separately.
If you married abroad, review Spanish Civil Registry registration early. The checklist calls for a Spanish Civil Registry marriage certificate, so an apostilled foreign certificate alone may not complete the nationality file.
Foreign documents generally need the appropriate apostille or legalisation and an official Spanish translation, unless an applicable exemption applies. Check validity and certification requirements before ordering them.
4. Are CCSE and DELE exams required?
Marriage to a Spanish citizen does not itself exempt you from the nationality exams.
The Instituto Cervantes administers:
- CCSE: constitutional and sociocultural knowledge of Spain.
- DELE A2 or above: evidence of Spanish-language ability.
Adult applicants generally need to meet both requirements unless an exemption, recognised alternative qualification or approved dispensation applies.
For example, the nationality rules exempt nationals of specified Spanish-speaking countries from the DELE requirement. That does not automatically exempt them from CCSE.
Check the evidence needed for your exemption before booking an exam or filing. Speaking Spanish fluently, being married to a Spaniard or having lived in Spain for a long time is not, by itself, documentary proof of an exemption.
5. Where to apply and what it costs
The application is for nationality by residence, submitted to the Ministry of Justice. The official electronic serviceallows applicants to file themselves or through an authorised representative.
A practical preparation sequence is:
- Confirm your eligibility and filing date.
- Check exams, exemptions and dispensations.
- Obtain and review the required certificates.
- Pay the fee and retain the receipt.
- Complete, sign and submit the application.
- Keep the registration receipt and monitor notifications.
Creating an online draft is not the same as submitting a signed application.
As checked on 8 October 2026, the Ministry lists the nationality application fee as €104.05. The relevant payment form is Modelo 790, código 026.
This fee does not cover exams, apostilles, translations or professional assistance. Check the current official amount before paying rather than treating a general online price range as your total budget.
6. How long does the application take?
Royal Decree 1004/2015 provides a one-year period for the decision and notification from receipt by the competent Directorate-General. Requests for missing documents can affect the deadline calculation.
This procedural period is separate from the year of residence required before you can apply. It is not a guarantee that you will hold a passport one year after filing.
If the applicable deadline passes without an express decision, the regulation provides for negative administrative silence. Silence does not grant nationality automatically. Have the file and available legal options reviewed.
Monitor formal notifications and respond within the stated deadlines. Filing a nationality application does not itself renew your residence permission.
7. What happens after approval?
A favourable decision is an important step, but there are still formalities to complete:
- Take the required oath or promise.
- Make the declaration about your previous nationality where required.
- Complete registration of the acquisition in the Spanish Civil Registry.
- Obtain the documentation needed to apply for your Spanish DNI and passport.
The regulation sets a 180-day period, counted from the day after notification, for the required declarations and request for registration. Arrange the next steps promptly and follow the instructions in your decision.
The Ministry’s oath guidance confirms that the oath or promise can be made before the competent Civil Registry official or before a notary. A notarial oath still requires the resulting document to be sent to the Civil Registry for registration.
Whether a renunciation declaration is required depends on the applicable Spanish rules and treaties. Its effect on your original nationality also depends on that country’s law. Marriage does not create a universal right to retain both nationalities.
Frequently asked questions
Does a pareja de hecho give the same one-year nationality route?
No. The shortened spouse route in Article 22 refers to marriage to a Spanish citizen. A registered partnership may be relevant to residence, but it is not equivalent to marriage for this nationality provision.
Can I apply while living abroad with my Spanish spouse?
Ordinarily, you need qualifying residence in Spain. A long marriage while living abroad does not replace that requirement. The Civil Code contains a specific rule for spouses living with Spanish diplomatic or consular officials accredited abroad; obtain advice if that applies to you.
What if we separate before or during the application?
If you are legally or factually separated when you apply, you cannot rely on the shortened spouse route. If circumstances change during processing, have the effect assessed and communicate changes that may affect the file. Do not assume every later change produces the same outcome.
Can I submit the application without a lawyer?
Yes. The Ministry’s electronic service allows an applicant to submit their own application. Professional assistance can be useful when residence dates, absences, marriage registration or document requirements need closer assessment.
