Residence Permit Rejection in Spain: What to Do Next (2026)

Documents stamped “REFUSED”, a magnifying glass and a Spanish flag, illustrating residence permit appeals in Spain.

A residence permit rejection in Spain can affect your plans, employment and immigration status. Your next steps depend on the decision you received, the reason given and the deadline for challenging it.

Start with the complete refusal notice and proof of notification. Then assess whether to appeal, submit a new application or consider another eligible route.

Two questions need separate answers: how can you challenge the refusal, and what currently allows you to remain or work in Spain? Filing an appeal does not automatically resolve the second question.

Identify the decision you have received

Check the document itself before deciding what to submit next.

Document or wordingWhat to establish
Request for further documents — requerimientoThe application is awaiting a response. Check the requested evidence and response deadline.
Refusal — denegaciónIdentify the reasons for the negative decision and the available challenge.
Inadmissibility — inadmisiónEstablish why the authority did not admit the application for consideration.
Withdrawal or closure — desistimiento or archivoCheck whether the file was closed because of a procedural issue, including an unanswered request.

A status message on an online tracker is not a substitute for the full decision.

Record the application reference, issuing authority, permit category and whether the decision states that it ends the administrative appeal stage: “pone fin a la vía administrativa.”

A consular visa refusal is a separate decision from refusal of a residence authorization. If a consulate refused your visa, see our guide to appealing a Spanish visa denial.

Establish the legally effective notification date

The date printed on the decision is not necessarily the date from which your appeal deadline runs.

Keep the notification receipt, electronic acknowledgment or delivery record. If a representative receives notifications for you, obtain their record as well.

For electronic notifications, check the relevant official portal, such as DEHú. The government’s guide to accessing notifications explains how to retrieve the decision and acknowledgment.

Where electronic notification is compulsory or expressly chosen, it can be deemed rejected after 10 calendar days without access. Leaving a notification unopened is therefore not a way to preserve an appeal deadline.

Ask for the exact final filing date to be calculated. Administrative periods expressed in months follow calendar-month rules; one month does not mean 30 days. Judicial time limits have their own calculation rules.

Choose the correct appeal route

There is no single appeal procedure for every Spanish residence refusal. Read the appeal instructions in the decision and check them against the governing legislation.

The following table summarizes the usual routes for an express decision that has been validly notified:

RouteWhen it is relevantGeneral filing period
Recurso de alzadaA decision that does not end the administrative appeal stage; review by the competent higher authority. One month.
Recurso potestativo de reposiciónAn optional request for reconsideration by the same authority where the decision ends the administrative appeal stage. One month.
Recurso contencioso-administrativoA court challenge once the administrative stage has been exhausted or where direct judicial review is available.Generally two months.

These periods are generally counted from the day after valid notification. They are filing periods, not additional periods of lawful residence. Administrative silence, defective notification and special procedures need separate assessment.

Recurso de alzada

The official guidance on recurso de alzada explains this administrative appeal and its one-month filing period for express decisions.

For residence authorizations processed under Law 14/2013, Article 76 expressly provides for an alzada appeal. This matters for UGE procedures, including international teleworker residence authorizations.

A Digital Nomad Visa applicant should therefore identify whether the refusal concerns a UGE residence authorization or a consular visa.

Our guide to common Digital Nomad Visa rejection reasons explains issues that may need to be addressed in these cases.

Recurso potestativo de reposición

The official guidance on reposición covers this optional reconsideration procedure.

Where it is available, the decision may also be challenged directly in court. If you choose reposición, judicial proceedings must generally wait until it has been expressly decided or deemed dismissed.

Choosing the route should follow an assessment of the refusal grounds, evidence, urgency and available remedies.

Judicial review

Law 29/1998 governs administrative court proceedings. Article 46 generally sets a two-month period for challenging an express act that ends the administrative stage.

Have a lawyer confirm the competent court, filing deadline, representation requirements and whether interim protection should be requested.

An ordinary email asking the authority to reconsider is not a substitute for a properly filed appeal.

Match the refusal grounds to the application record

An effective challenge needs to explain why the decision should change.

Compare each stated reason with the documents actually submitted, any request for further evidence and the response registered before the decision.

Issue raised in the refusalEvidence to review
Financial means were not establishedAccount ownership, relevant dates, statements, source of funds and the calculation used for the category.
A foreign document was not acceptedThe original document, issuing authority, apostille or legalization requirements and translation.
A request was allegedly unansweredNotification records, the response deadline, submission receipt and the documents attached.
Eligibility was not demonstratedThe applicable legal requirement and the evidence addressing it at the relevant time.

Keep the complete submission, including attachments and registration receipts. A document saved on your computer does not prove that it reached the authority.

Where additional evidence is proposed, explain what it establishes and why it was not already in the file. Law 39/2015 contains restrictions on evidence that could have been provided earlier but was not.

Distinguish between proving that a requirement was already met and changing your circumstances so that you qualify now. That distinction can influence whether an appeal or a fresh application is the stronger option.

Check your right to remain and work in Spain

Submitting an appeal does not, by itself, suspend the refusal or restore residence and work rights.

Review your current position separately: any existing authorization, its expiry date, the effects of the refusal and any other lawful basis for remaining in Spain.

If your previous authorization was extended while a renewal was pending, check how the negative decision affects that position.

What if the refusal includes departure instructions?

Read them immediately. The Immigration Regulation contains rules on compulsory departure where applicable.

Do not assume that a one-month appeal period also gives you one month to remain in Spain. The relevant departure instructions and appeal deadline must be reviewed separately.

Can suspension or interim protection be requested?

Depending on the case, an administrative suspension request or judicial interim measures may be appropriate.

Article 117 of Law 39/2015 governs administrative suspension. Articles 129 and following of Law 29/1998 govern judicial interim measures.

The request needs a legal basis and supporting evidence. Its scope and effects must be assessed; submitting the request is not the same as obtaining the protection sought.

Before continuing work or planning travel, confirm which rights your actual status or any effective protective measure provides. An appeal receipt alone is not a residence card or re-entry document.

Decide whether a fresh application is appropriate

A new application may be worth considering where a correctable problem has been resolved or your circumstances now support an eligible route.

For example, a new application might be assessed differently after obtaining a qualifying contract or resolving a document-formality issue. However, the route must permit the application from your current location and immigration situation.

Before refiling, establish:

  • Whether all relevant eligibility requirements are now met.
  • Whether you can apply from Spain or need a procedure abroad.
  • Whether another application or appeal affects the proposed procedure.
  • Whether the new evidence addresses the original problem.
  • Whether challenging the earlier decision remains useful.

A fresh application does not reset the deadline for appealing the earlier refusal. It also does not automatically restore lawful stay or work rights.

Avoid submitting the same file again without addressing the reasons given.

Prepare and register the response

For a structured legal review, assemble:

  1. The full decision and proof of notification.
  2. Your passport and relevant visas, authorizations or residence cards.
  3. The original application, attachments and registration receipt.
  4. Any requests for further documents and the responses submitted.
  5. Evidence addressing each refusal ground.
  6. A chronology of the application, notifications and relevant changes.

The appeal should identify the challenged decision, explain the factual and legal grounds and state the outcome requested.

Use the appropriate filing channel and keep the registration acknowledgment, including the filing date and document list. If a representative files for you, obtain a complete copy.

What happens after an appeal is submitted?

Continue monitoring official notifications and respond to any procedural requests.

The statutory period for deciding an alzada appeal is generally three months. For reposición, it is one month. These periods differ from the filing deadline and from the processing period for the original application.

Silence is not a general guarantee that an appeal has succeeded. Its consequences and the next available step depend on the applicable procedure.

A successful challenge can have different results, including replacement of the decision or reconsideration of the application. It does not always result in an immediate residence grant.

Frequently asked questions

Can I stay in Spain while my appeal is pending?

A pending appeal alone does not establish a right to remain. Check your existing status, the decision and any effective suspension or interim measure.

Can I simply submit a new application?

That depends on the route, your location, your status and any pending procedures. Review these conditions before refiling.

What if I missed the appeal deadline?

Have the notification and deadline calculation reviewed promptly. Defective notification and exceptional remedies require individual assessment; they do not provide an automatic extension.

Does hiring a lawyer guarantee that the refusal will be reversed?

No. The outcome depends on the legal requirements, evidence, procedural history and assessment of the authority or court.
