Spain’s 2026 regularization: next steps, with a couple reviewing documents with an immigration lawyer.

Last updated: 6 October 2026

Spain’s 2026 mass regularization was a temporary procedure for eligible people already living in Spain. The deadline for new applications was 30 June 2026 and has now passed.

This guide explains the next steps for applications submitted on time, including document requests, provisional work rights, decisions and residence options for people who missed the deadline.

Can I still apply for the 2026 extraordinary regularization?

The application period for this particular procedure has closed. The end of the filing period does not prevent the administration from continuing to assess applications submitted within it.

If you applied on time, your next step depends on the stage of your case. If you did not apply, assess another residence route under its own current rules.

I applied on time. What should I check now?

Keep an organised copy of your file, including:

  • The application and registration receipt.
  • The documents originally submitted.
  • Any communication confirming the start of processing.
  • Requests for additional documents and proof of your replies.
  • Fee receipts and any decision received.

Check your case status and the notification channel recorded in your application. Electronic notifications may be sent through DEHú. If a representative filed for you, agree who will monitor and respond to communications.

What should I do if I receive a request for documents?

Read the complete notice before preparing your response. Identify each requested item, the deadline and the method for submitting it.

The Ministry currently directs applicants to submit supplementary documents through Mercurio or an authorised Correos office. Follow the instructions for your existing case.

A useful response clearly identifies the case and explains which attachment answers each requested point. Check that scans are readable, complete and consistent with the details in your original application.

If the request concerns a foreign document, check the applicable translation, apostille or legalisation requirements. If obtaining it presents a difficulty, have the notice reviewed promptly so that any appropriate procedural request can be made before the deadline.

Keep proof that the response was registered. Sending documents to a lawyer or obtaining them from an issuing authority is only part of preparing the reply.

Can I work while my application is pending?

Under the extraordinary procedures, provisional permission to reside and work arises from the administration’s communication confirming the start of processing. A filing receipt alone should not be treated as that communication.

The provisional authorisation covers employed and self-employed work in Spain, subject to the applicable employment and Social Security obligations.

The Ministry’s interpretative criterion of 22 July 2026 confirms that this provisional permission remains valid until an express decision is notified. Passing the decision deadline and negative administrative silence do not, by themselves, extinguish an existing provisional authorisation.

Keep the administrative communication recognising your provisional rights available for your employer. Your Social Security number, or NUSS, is an identifier; starting employment also involves the appropriate Social Security registration.

What happens if more than three months have passed?

The regulations set a maximum decision and notification period of three months, counted from the day after the application enters the register of the competent processing body. Legally permitted suspensions can affect that calculation.

The applicable silence is negative administrative silence, which allows the applicant to pursue the appropriate challenge to the lack of a decision. It does not grant residence automatically.

The administration remains obliged to issue an express decision. If your case is delayed, review the registration date, any suspension and all notifications before deciding whether to appeal or make another procedural request.

What should I do after approval?

Read the decision carefully and record the authorisation’s validity dates.

The Ministry requires the TIE application within one month of notification of approval. Check the police appointment procedure and document checklist for your place of residence, then prepare the required forms and supporting documents.

Nodisea can assist with appointments and preparation through our TIE application service.

Keep the approval, notification and TIE application records together. Set reminders for the next immigration deadline using the dates in your own decision.

What happens when the authorisation approaches expiry?

The initial adult authorisation under the extraordinary procedures normally lasts one year. Holders should assess a modification to another residence authorisation under Article 191 before expiry.

The regulations also provide exceptional extensions where the specific conditions are met. These can involve active job seeking, a qualifying integration report or certain justified circumstances preventing access to employment.

The appropriate application depends on the authorisation and the holder’s circumstances. Review employment, Social Security records and any relevant personal evidence in advance so that the next application can be prepared within its applicable filing period.

What if my application is refused?

Have the decision reviewed promptly, including the reasons given, the notification date and the appeal instructions.

Bring together the refusal, the original application, any document requests and proof of responses. This helps establish whether the issue concerns eligibility, missing evidence, document validity or another matter.

An express refusal ends the provisional work authorisation under these procedures. Employees must inform their employer of the outcome. Any challenge and its effect on your position need a separate assessment.

I missed the deadline. What residence options remain?

Other residence routes may still be available, depending on your time in Spain, previous permits, employment, family relationships and personal circumstances.

Arraigo social generally requires at least two years of continuous presence in Spain, together with qualifying family ties or a favourable social integration report, the relevant financial evidence and the other legal conditions. Time spent as an international protection applicant until a final administrative or, where applicable, judicial decision generally does not count towards that period.

Our guide to arraigo in Spain explains the main categories. For a wider overview, read our guide to residence options for people living in Spain without a residence permit.

The ordinary arraigo routes have their own requirements. An assessment should identify the route and evidence that fit your circumstances.
