Legal assistance for immigration in Spain can help you choose an appropriate residence route, prepare the evidence your application needs and manage communications with the authorities.
However, the support you need depends on your circumstances. Someone with a straightforward application may want a document review, while someone facing a refusal or a complicated employment situation may need advice and representation throughout the procedure.
This guide explains when an immigration lawyer can add value, what to check before hiring one and how to prepare for an initial consultation.
Is an immigration lawyer compulsory in Spain?
Many administrative immigration applications can be submitted without hiring a lawyer. Check who is entitled to apply and the filing requirements for your particular procedure.
Article 5 of Law 39/2015 allows applicants to act through a representative and requires proof of representation for actions such as submitting applications and administrative appeals.
For international teleworker residence applications, the official UGE documentation instructions expressly allow submission by the applicant or an authorised representative.
Court proceedings follow different rules. Under Article 23 of Law 29/1998, assistance by a lawyer is generally required in administrative court proceedings, with representation by a procurador also required before collegiate courts.
Whether legal assistance is optional therefore depends on the stage and procedure involved.
When can legal assistance be particularly useful?
Consider seeking advice when an unresolved question could affect your eligibility, filing deadline or supporting evidence.
| Your situation | What a legal review can help establish |
|---|---|
| Several residence routes appear possible | Which requirements you can meet and how each route fits your plans |
| You work remotely for a foreign business | How your employment or professional relationship should be documented |
| You own or control the company paying you | What evidence supports the company’s activity and your relationship with it |
| Your family will apply with you | Which relatives qualify and what relationship and financial evidence is needed |
| Documents come from several countries | Which certificates, authentication steps and translations the procedure requires |
| You have received a request for documents or a refusal | What the authority is questioning and which response or remedy needs assessment |
These are examples of situations worth reviewing, rather than an exhaustive list.
A useful consultation should identify the specific issue in your case and explain what evidence or action could address it.
Applying independently may be a reasonable option
You may feel comfortable managing an administrative application yourself if the requirements are clear, your documents support them and you can handle the filing and notification systems.
Before deciding, check that you can:
- Identify the correct application procedure.
- Understand the current official instructions.
- Prepare and submit the necessary evidence.
- Monitor notifications and respond within the applicable deadlines.
- Keep a complete copy of the submission and receipt.
If uncertainty concerns one part of the application, ask whether a focused consultation or review would address it.
Example: legal assistance with a Digital Nomad Visa application
A remote job and regular income are only part of the assessment for Spain’s international teleworker route.
Law 14/2013 distinguishes employment from professional activity and sets requirements concerning the foreign business, the existing relationship, remote working and qualifications or professional experience.
A practical review could examine whether:
- Your contract accurately reflects how you work.
- The company documents establish the relevant business activity.
- Payment records are consistent with the contract and invoices or payslips.
- Your evidence supports the qualification or experience requirement.
- The proposed Social Security arrangements fit your working relationship.
The UGE instructions distinguish employee and self-employed arrangements. Where continued coverage under a foreign Social Security system is relied upon, the relevant international instrument and certificate must support remote work from Spain.
For example: if a contract describes you as an employee but other documents describe you as an independent contractor, that inconsistency should be assessed before filing. Changing a label without checking the underlying relationship may leave the problem unresolved.

What should an immigration legal service include?
The scope should be clear before you engage the professional. When comparing services, distinguish between different levels of assistance.
| Service | Typical purpose | What to clarify |
|---|---|---|
| Initial legal consultation | Assess your circumstances and identify possible routes or issues | Whether documents will be reviewed and whether written advice is included |
| Document review | Examine the evidence for a defined application | Whether forms, translations and a final review are included |
| Application preparation and representation | Prepare and submit the application and manage agreed follow-up | Who monitors notifications and whether responses to requests are included |
| Appeal assistance | Assess and challenge a particular decision | Whether the engagement covers an administrative appeal, court proceedings or both |
The exact work depends on the agreement. A service described as “full support” should still explain its scope.
Representation and electronic filing
Where a professional submits an application on your behalf, the representation must be properly established.
UGE states that applications under Law 14/2013 and related submissions must be made electronically through the Ministry’s designated system. Its application guidance also explains the electronic certificate requirement.
Ask who will receive notifications and how important communications will reach you.
Under Article 43 of Law 39/2015, a mandatory or expressly chosen electronic notification is treated as rejected after ten calendar days without access. Agreeing who monitors notifications is therefore an important part of managing the file.
Support after a favourable decision
Ask whether the service includes guidance on the TIE process, relevant registrations and future renewal planning.
Also clarify whether tax advice, Social Security registration, translations and other professional services are included or quoted separately.
How to choose an immigration lawyer in Spain
Start by identifying the lawyer responsible for your matter and confirming their professional registration.
The Spanish General Council of the Legal Profession provides a General Census of Lawyers. You can also contact the relevant Bar Association.
Before engaging a professional, ask:
- Who will be responsible for my case?
Clarify the roles of the lawyer and any case managers or other professionals. - What experience do you have with this procedure?
Ask about cases involving circumstances similar to yours. - What needs resolving before we can apply?
Look for an explanation of eligibility questions and missing evidence. - What does the quoted service include?
Confirm filing, notification monitoring, responses to requests and post-approval support. - How will we communicate?
Agree on your contact person, language and how you will receive documents and updates.
The General Statute of the Spanish Legal Profession requires lawyers to provide identification information and explain the viability, fees and costs of the matter.
How much does immigration legal assistance cost?
Professional fees are freely agreed between the lawyer and client. Compare written quotes for the same scope of work.
Ask the quote to distinguish:
- Professional fees and applicable VAT.
- Government application fees.
- Translation, authentication and other external costs.
- Work charged separately, such as an appeal or renewal.
- Payment stages and the applicable contractual terms.
The professional statute addresses client information and engagement terms in Articles 27 and 48. A written engagement letter helps make those terms clear.
What if you have already received a request or refusal?
Send the complete document to the professional assessing your case, together with the notification record.
For a request for additional documents, a useful review should connect each point raised by the authority with the evidence needed to answer it. An explanation may help clarify documents, but it cannot replace evidence that the procedure requires.
For a refusal, provide the original application and attachments as well. The review should examine the reasons given and assess the available response, including the relevant deadline.

Will hiring a lawyer guarantee approval or a faster decision?
No. The competent authority decides the application.
Legal assistance can help identify gaps, organise evidence and manage procedural steps. It cannot guarantee approval or a particular decision date. Treat any promised timeline as something that needs a clear explanation.
What should you prepare for an initial consultation?
Prepare a short summary of your circumstances and your main question.
Useful information includes:
- Your nationality and current country of residence.
- Your current Spanish immigration status, if applicable.
- Relevant entry, expiry and notification dates.
- Your work, income and family circumstances.
- The residence route you are considering.
- Any previous applications, requests or decisions.
If you have already filed, have the submission receipt and a copy of the documents ready.
You can ask about the consultation’s scope before sending a large file or ordering translations.
Frequently asked questions
Can I hire a lawyer after submitting the application myself?
Yes. A lawyer can assess an existing file and, where appropriate, arrange representation. Provide the complete submission and all communications received so far.
Can an immigration lawyer help if I am outside Spain?
Yes. Advice and document preparation can often be provided remotely. Whether an application can be submitted on your behalf depends on the procedure and the competent authority’s requirements.
Does a document review include representation?
Only if that is part of the agreed service. Reviewing documents and submitting an application are different tasks.
Are translations and apostilles included in legal fees?
Check the quote. Coordination and the external cost of obtaining those services may be treated separately.
What if I only need help with one issue?
Describe the issue and ask whether a focused consultation or review is available. Examples include assessing a contract, checking an official request or comparing possible residence routes.
