Comparing an immigration lawyer vs migration agent in Spain starts with checking who will actually handle your case. An English job title or a company’s marketing description may tell you little about the professional qualifications behind its services.
This guide explains the roles of lawyers, registered administrative managers and other advisers, so you can choose support appropriate to your application.
What Is an Immigration Lawyer in Spain?
A practising Spanish lawyer, or abogado, holds the required professional qualification and is registered with a Spanish Bar Association as a practising member, known as ejerciente.
Lawyers provide legal advice and defend clients’ rights and interests. An immigration lawyer focuses their practice on matters such as visas, residence permits, nationality and immigration disputes.
Professional registration and relevant experience are separate questions. Ask whether the lawyer regularly handles your particular application route and who will take responsibility for your case.
Spain’s General Statute of the Legal Profession explains professional status and scope of practice in Articles 4 and 5.
What Does “Migration Agent” Mean in Spain?
When comparing providers, treat the label “migration agent” or “immigration consultant” as incomplete information until the provider explains their actual professional status.
Ask whether the person is a lawyer, a registered gestor administrativo, a relocation adviser or an administrative coordinator. Also clarify who provides any legal advice included in the service.
A registered gestor administrativo is a regulated professional with their own qualification and professional registration requirements. Their work includes handling administrative procedures within their professional remit, excluding activities legally reserved to other professions.
A gestor administrativo is not automatically a lawyer. Equally, an adviser using the word “agent” should not automatically be assumed to hold the qualifications of a registered gestor.
The Statute of the Gestor Administrativo Profession, particularly Articles 1 and 6, sets out the profession’s functions and entry requirements.
Comparing the Different Roles
| Professional | Status to verify | Services to clarify |
|---|---|---|
| Immigration lawyer | Practising registration with a Spanish Bar Association. | Legal assessment, application management, administrative appeals and court assistance, according to the agreed services. |
| Registered gestor administrativo | Registration with an official College of Gestores Administrativos. | Administrative preparation, submission and follow-up within their professional remit. |
| Migration consultant or relocation adviser | Actual qualifications and the identity of any regulated professionals involved. | Document coordination, practical relocation assistance and any application support they are authorised to provide. |
A company may employ several types of professionals. Confirm who will perform each task and who is responsible for legal advice.
Who Can Submit an Immigration Application?
Many administrative immigration procedures allow applicants to act on their own behalf or through an authorised representative.
Under Article 5 of Law 39/2015, representation must be properly evidenced for actions such as submitting applications and administrative appeals.
Always check the rules for the particular procedure, including any personal attendance requirements. Authorisation to submit documents does not, by itself, establish that the representative is a practising lawyer.
When Is Legal Advice Particularly Useful?
Consider seeking legal advice when:
- You are unsure which visa or residence route fits your circumstances.
- Your documents contain inconsistencies or leave an eligibility requirement unclear.
- You have received a refusal or a request for additional evidence.
- Your immigration history includes an expired permit or a previous unsuccessful application.
- You need to assess an appeal, a court challenge or an urgent deadline.
Administrative support can help organise a file and complete procedural tasks. When the main question is how the law applies to your circumstances, ask who will provide that assessment.
For example, arranging translations and organising documents are different tasks from assessing whether those documents establish eligibility for a particular residence permit.
Administrative Appeals and Court Proceedings Are Different
An administrative appeal asks the relevant public authority to review a decision. A judicial challenge brings the matter before a court.
A lawyer is not universally required for every administrative appeal. However, the representative’s professional remit and the rules governing the particular procedure still matter.
For ordinary challenges to immigration decisions before the contentious-administrative courts, legal assistance by a lawyer is generally required. A procurador, a separate court representative, may also be necessary depending on the court and procedure. These rules are addressed in Article 23 of Law 29/1998.
If a provider offers “appeal support”, ask whether that means an administrative appeal, judicial proceedings or referral to another professional. Confirm the scope and fees before proceeding.
How to Check Credentials and Services
Before hiring a provider:
- Identify the responsible professional. Obtain their full name and actual professional role.
- Check registration. For a lawyer, use the Censo General de Letrados or contact the relevant Bar Association. For a gestor administrativo, check with their official professional college.
- Confirm relevant experience. Ask about the specific application route and authority involved.
- Request a written scope of services. Clarify whether the service includes eligibility assessment, submission, responses to document requests and post-approval assistance.
- Compare the complete cost. Check VAT, accompanying family members, translations, government fees and any separate appeal work.
Keep copies of your service agreement, submissions, payment receipts and official notifications.

Frequently Asked Questions
Does Having a Law Degree Mean Someone Can Practise as a Spanish Lawyer?
A law degree alone does not establish practising status. Check the professional’s admission and current registration with the relevant Bar Association.
Can a Law Firm Use Case Managers and Administrative Assistants?
Yes. Different team members may coordinate documents and manage administrative tasks. Ask which lawyer is responsible for legal advice and how you can contact them when necessary.
Is a Migration Agent Always Cheaper Than a Lawyer?
Compare actual proposals rather than assuming a price difference from the job title. The cost depends on the work included, the complexity of the case and any additional services.
A document coordination service and legal representation throughout a disputed application are different scopes of work.
