La vía de la Ley de Memoria Democrática está cerrada
El plazo para solicitar por la Ley de Memoria Democrática, la “ley de nietos”, se cerró el 22 de octubre de 2025 y no se ha ampliado. Ya no se admiten nuevas solicitudes por esa ley. Los expedientes presentados antes del plazo siguen tramitándose con normalidad.
Si lo perdiste, no es el final. Los hijos y nietos de quien fue originariamente español pueden obtener la nacionalidad tras un año de residencia legal en España. Es otra vía, con un requisito de residencia que la Ley de Memoria no tenía, pero lleva al mismo pasaporte.

Ambos se reservan a través del Instituto Cervantes y tienen convocatorias limitadas que se llenan. Son el paso que con más probabilidad retrasa un expediente que ya está listo, y el único que no puedes hacer en el último momento. Resérvalos primero, no al final.

- Justificante de pago de la tasa

- Casado con español: certificado de matrimonio del Registro Civil español, certificado de nacionalidad de tu cónyuge y empadronamiento conjunto
- Hijo o nieto de español: la partida de nacimiento de tu padre, madre o abuelo español y la cadena de certificados que te vincula con ellos
- Estatuto de refugiado: la resolución de reconocimiento y la documentación de tu estatuto
- Origen sefardí: la certificación y las pruebas que acrediten tu ascendencia

Thank you to the team at Nodisea, especially Francisco and Dahianna. We are from Canada and applied in Spain for our Digital Nomad Visa. Our application was submitted May 31, and we received approval June 26; there was only one clarification, for sworn translation of the relevant documents. That is approximately 18 business days.
I highly recommend this team as they have a very structured process for collaboration via Drive, email, and WhatsApp. They maintained organization throughout the process but were also readily available for questions and clarifications. This structure and organization gave us confidence and I believe contributed to the timely resolution of our application.
This collaboration and availability also helped us work through several potential issues such as differences with incorporation documents from Canada, the introduction of the apostille process in Canada, and getting certain documents apostilled at the Embassy in Madrid.
