Changing from a non-lucrative visa to a work permit in Spain may be possible without applying for a new visa abroad. The appropriate route depends on your residence history and whether you intend to work for an employer or become self-employed.

Non-lucrative residence does not itself authorise employment or professional activity. Receiving a job offer, registering a business or submitting a modification application does not automatically change that position.

This guide explains the current framework, how to prepare the application and what must happen before you start working.

Can You Change Non-Lucrative Residence to a Work Permit?

Yes, provided you meet the requirements of the relevant authorisation.

The application changes your residence authorisation, rather than simply replacing a visa sticker or updating the wording on your TIE.

The main framework is Article 191 of Royal Decree 1155/2024. The Ministry’s modification guidance for residence without work rights distinguishes the following situations:

Residence history and proposed activityMain frameworkKey point
Less than one year as a resident; employee applicationArticle 191.2All Article 74 requirements apply, including the national employment situation, unless an applicable exemption applies.
At least one year as a resident; employee applicationArticle 191.4The national employment situation requirement in Article 74.1(a) is excluded. The remaining requirements still apply.
At least one year as a resident; self-employed applicationArticle 191.4The proposed activity must meet the Article 84 requirements.

Completing a year of residence can therefore change the conditions of an employee application. It does not establish that a particular employer, contract or business project qualifies.

For the conditions attached to your current status, see our Non-Lucrative Visa Spain guide.

Can You Apply Before Completing One Year?

The current regulations provide an employee route for residents who have not yet completed one year.

In that situation, the national employment requirement needs particular attention. Depending on the case, recruitment may be supported by:

  • An occupation covered by the relevant shortage occupation catalogue.
  • Evidence through the prescribed employment-service procedure that the vacancy cannot be filled in the domestic labour market.
  • An applicable statutory or international-agreement exemption.

Check the SEPE shortage occupation information and the Ministry’s guidance on national employment exemptions.

A company’s willingness to hire you does not, by itself, answer this question. Establish the applicable basis before preparing the rest of the file.

Filing near the end of the first year also requires care. For example, Catalonia’s published guidance for the employee procedure MOD01b permits advance filing within the two months before the existing authorisation expires. Check the applicable filing criteria with the competent authority rather than assuming you must wait until the final day.

If you want to become self-employed before completing a year, obtain an assessment of the specific route available. The Ministry’s express under-one-year modification section concerns employee applications.

Changing to an Employee Work Permit

An employee application — por cuenta ajena — relies on a qualifying employment relationship and evidence about both the worker and employer.

Review the Contract and Salary

The contract should be signed by both parties, cover the required continuity of employment and make the start date conditional on the work authorisation becoming effective.

Review the position, duties, hours, annual gross remuneration and applicable collective agreement together. A document labelled “job offer” may leave essential conditions unresolved.

The relevant rules also address part-time contracts: total annual remuneration must meet at least the full-time annual SMI threshold. Do not assume that the immigration salary condition can simply be reduced in proportion to the hours.

Check the Employer’s Evidence

The employer must meet its tax and Social Security obligations and demonstrate sufficient resources to fulfil the contract.

Prepare the evidence with the employer before filing. Identify who can sign for the business, which financial records support its capacity and whether the company details match the contract.

If a document is missing, arrange it early. An otherwise suitable job can become difficult to present when the employer’s part of the application has not been prepared.

Establish the Required Professional Qualifications

Qualifications and professional recognition depend on the work proposed.

Where the occupation is regulated, check the recognition, registration or professional authorisation required in Spain. For other roles, identify the evidence that demonstrates the relevant capacity.

The Ministry’s employee authorisation guidance explains these substantive requirements. Use the modification procedure for your application, rather than copying the overseas visa steps from an initial recruitment guide.

Changing to a Self-Employed Work Permit

A self-employed application — por cuenta propia — needs evidence supporting the proposed activity.

The official self-employed requirements address sufficient investment, professional capacity and the legal conditions for opening and operating the activity.

Prepare a project that an examining officer can understand:

  • What service or product will you provide?
  • Where will the activity operate?
  • What equipment, premises or other resources will it need?
  • Which permissions or professional registrations apply?
  • How much investment is required, and how will it be funded?
  • What evidence supports the expected demand and revenue?

A useful business plan connects these points with the supporting documents. Explain your assumptions and distinguish confirmed arrangements from projections.

For example, a service business might use equipment quotations, evidence of available funds and prospective client commitments to explain how it will operate. A business requiring premises needs a different assessment of costs, permissions and practical readiness.

There is no single investment figure in Article 84 that applies to every project. The evidence must support the needs of the actual activity. The regulation also recognises self-employment itself when considering employment creation.

Documents to Prepare

Build the checklist around the selected route and the competent authority’s current instructions.

For the State modification procedure, the Ministry identifies EX-26. Regional procedures can use their own application forms.

The following is a practical preparation checklist; the documents and format required must be confirmed for the individual file.

Part of the fileEvidence to organise
IdentityComplete, valid passport or accepted travel document.
Current residence and timingCurrent TIE, previous residence decision and relevant entry or validity evidence.
Application and representationCorrect form, required signatures and evidence of any representative’s authority.
Employee applicationSigned contract, employer identification and representation, financial evidence and relevant professional documents.
Recruitment before one yearEvidence addressing the national employment requirement or the applicable exemption.
Self-employed applicationProject description, investment evidence, professional capacity and the applicable licences, declarations or permission records.
FeesCorrect payment forms and receipts for the procedure.

Organise the file so that each document answers a particular requirement. Check names, passport details, company identifiers and dates across the application and supporting records.

For foreign documents, assess translation and authentication separately. Public documents may need an apostille or legalisation unless an exemption applies. Professional recognition is also a separate question from translation.

Our apostille and legalisation guide explains how to review those formalities.

How to Apply: Step by Step

1. Establish Your Residence Timeline

Confirm the start and expiry of your current authorisation and the applicable modification category.

For initial non-lucrative residence, the Ministry states that validity begins on entry into Spain. The date you collected the physical TIE may therefore be different.

Keep the visa, entry evidence, residence decision and card available for this review. Resolve any discrepancy before relying on a particular filing date.

Start preparing the employer’s documents or business project well before expiry. If the application is not ready, assess how to maintain lawful residence rather than assuming an incomplete modification will solve the timing problem.

2. Identify the Correct Authority and Form

The resident or employer can submit the modification, subject to the relevant representation requirements.

The Ministry’s State procedure identifies the competent immigration office and electronic filing through Mercurio.

Where an autonomous community has the relevant transferred work-authorisation competence, its procedure must be checked separately. In Catalonia, employee and self-employed modifications can use Generalitat procedures, including MOD01b and MOD01c.

Confirm the authority, filing channel and form before paying fees or uploading documents.

3. Submit the Application and Keep the Receipt

Check the selected procedure, signatures and attachments before submission.

Retain the registered application, receipt, file number and an exact copy of the documents submitted. These records help establish what was filed if the authority later requests clarification.

An upload confirmation should be checked to ensure it is the registration receipt for the completed application.

4. Pay the Correct Fees

The State procedure lists the following references:

FeeEmployee modificationSelf-employed modification
Residence processingModelo 790, code 052, heading 2.5.2; payable by the foreign resident.Modelo 790, code 052, heading 2.5.2.
Work processingModelo 790, code 062, heading 3.2.1; payable by the employer.Modelo 790, code 062, heading 3.3.1.

Check current amounts, exemptions and payment instructions. The Ministry’s modification guidance specifies a ten-working-day payment period following admission for processing.

For procedures within Generalitat competence, use its work-fee arrangements. A State code 062 payment should not be assumed to satisfy the regional work fee.

Keep the payment evidence with the application records.

5. Monitor Notifications and Respond to Requests

The Ministry’s guidance gives a three-month decision period, calculated from receipt by the competent body. If no decision is notified within the applicable period, the stated silence rule is negative.

Check the procedural history before calculating the deadline, including any request that affects the running of time.

A document request should be answered point by point. Supply the evidence requested, explain relevant inconsistencies and retain the response receipt.

Electronic notifications also need monitoring. Where electronic notification is mandatory or expressly chosen, Article 43 of Law 39/2015 provides for an unopened notification to be treated as rejected after ten calendar days from availability.

If you receive a refusal, obtain the full decision and notification evidence. Our Spanish residence permit refusal guide explains how to assess the grounds and possible next steps.

6. Complete Social Security Registration

Read the favourable decision in full and confirm the conditions for the authorisation to become effective.

The modification guidance requires Social Security registration within one month of notification. For employment, coordinate this with the employer; for self-employment, arrange the appropriate registration for the approved activity.

Keep evidence of the registration and check the effective dates. For the at-least-one-year route, Article 191.4 distinguishes cases where the previous permit has expired from cases where it remains valid.

Check any conditions concerning the employer, occupation, activity or geographical scope before accepting work.

Any backdating of the authorisation’s validity should not be treated as permission to work before the new authorisation becomes effective.

7. Apply for the Updated TIE

Complete the police documentation procedure after the work authorisation becomes effective.

The Ministry’s employee modification guidance identifies a one-month TIE application period following Social Security registration. Check the requirements for your category and decision.

Prepare the applicable police form, passport, photograph, fee receipt and evidence of the approved change and registration as required.

The TIE documents the new status. Its production is a separate step from the decision granting the authorisation and the conditions that activate it.

Can You Work While the Modification Is Pending?

A pending non-lucrative-to-work modification does not, by itself, grant permission to start working.

Keep these questions separate:

  • Is your existing residence authorisation valid, or otherwise lawfully maintained during processing?
  • Has the new work authorisation become effective?
  • Has the required Social Security registration been completed?
  • Does the activity fit the authorisation’s conditions?

Agree on the intended start date with the employer or prospective clients using the applicable authorisation requirements.

What If You Want to Work Remotely for a Foreign Company?

The location of the employer does not turn non-lucrative residence into permission to work from Spain.

If your intended activity is remote employment or professional work for overseas companies, assess whether Spain’s international teleworker route fits the arrangement.

That framework has separate requirements concerning the company, relationship, qualifications, financial evidence and Social Security position. It should not be treated as an automatic conversion available to every non-lucrative resident.

Our Digital Nomad Visa Spain guide explains that route.

Mistakes to Avoid

Common preparation problems include:

  • Using a checklist for non-lucrative renewal when a work modification is intended.
  • Choosing the residence category without checking the effective start date and filing criteria.
  • Obtaining a contract while leaving the employer’s supporting evidence unresolved.
  • Describing a self-employed project without evidence for its costs, funding or permissions.
  • Using the wrong authority’s form or fee arrangements.
  • Missing a notification or failing to answer a specific document request.
  • Agreeing to start work before the permission becomes effective.

Frequently Asked Questions

Do I Need to Return to My Home Country?

Article 191 provides an in-country modification framework for qualifying temporary residents without a new visa. Establish that your status and proposed application fall within it before making travel plans.

Is a Job Offer Enough?

No. Examine the contract, employer’s evidence, worker’s qualifications and the requirements applicable to the residence category. Where the national employment requirement applies, it must also be addressed.

Do I Have to Renew Non-Lucrative Residence First?

A non-lucrative renewal is not an automatic prerequisite for every modification. Assess eligibility and filing timing together, particularly near the first permit’s expiry.

Renewing non-lucrative residence alone does not add work rights.

How Long Does the New Permit Last?

The employee route under Article 191.2 and the change from residence without work rights under Article 191.4 provide a one-year authorisation. Check the effective dates in the decision and coordinate any required registration.

Does Registering as an Autónomo Give Me Work Permission?

Social Security registration and immigration permission must fit together. Registration alone does not establish that your non-lucrative status authorises the proposed work.

Is There a Fixed Investment Amount for Every Self-Employed Applicant?

Article 84 requires sufficient investment for the project. Explain the resources needed for your particular activity and provide evidence supporting their availability and use.

Does My Family Automatically Receive the Same Work Rights?

Assess each family member’s authorisation and residence basis separately. One person’s successful modification does not establish the permissions or application requirements of everyone in the household.
