Obtaining a work and residence permit in Spain requires more than receiving a job offer. The correct procedure depends on your nationality, existing immigration status and proposed employment.
For the ordinary initial employee route, the employer applies for an authorisation. The worker then completes the relevant visa and arrival formalities.
This guide explains that route, commonly called residencia y trabajo por cuenta ajena, and the questions to check before preparing an application.
Is This the Right Permit for You?
Start by identifying whether you need a new work authorisation.
EU, EEA and Swiss citizens generally follow the applicable free-movement framework. Qualifying family members may also have a different residence route.
A non-EU national who already holds permission to work in Spain may not need the ordinary initial employee procedure. Existing residents, students and applicants for specialised employment routes should check the rules relevant to their status.
Our EU vs. non-EU immigration guide explains the main distinctions.
A NIE is an identification number. It does not itself authorise employment.
The Main Stages of the Employee Route
For a worker residing abroad, the ordinary process involves separate stages:
| Stage | Who takes the main action? | Purpose |
|---|---|---|
| Initial authorisation | Employer or authorised representative | Request permission for the proposed employment and residence |
| Employee visa | Worker | Complete the consular procedure before travelling |
| Social Security registration | Employer | Register the employment before work begins |
| TIE application | Worker | Obtain the physical residence card where required |
Prepare the whole sequence before choosing a start date. Approval at one stage does not remove the requirements of the next.
What Must the Employer Demonstrate?
The application concerns both the worker and the employer.
The employer must be able to support the proposed activity and meet the obligations arising from the contract. Relevant checks include:
- Compliance with tax and Social Security obligations.
- Sufficient resources for the business and employment.
- A contract signed by both parties.
- Conditions consistent with employment law and the applicable collective agreement.
- A start date linked to the authorisation becoming effective.
The worker must hold any qualifications legally required for the profession.
Review the actual role, working hours, remuneration and workplace together. A contract should accurately describe the job that will be performed.
Does the Labour Market Test Always Apply?
The situación nacional de empleo, or national employment situation, can affect an initial application. However, there is no universal requirement to prove that every local candidate has been considered first.
The applicable basis should be identified before filing.
| Potential basis | What needs checking? |
|---|---|
| Shortage occupation | Whether the occupation appears in the relevant geographical catalogue |
| Difficulty filling the vacancy | The required recruitment process and supporting public employment service report |
| Statutory exemption | Whether a specific exemption under Article 40 of Organic Law 4/2000 applies |
| International agreement | Whether an applicable agreement covers the worker, including the arrangements identified for Chile and Peru |
The SEPE shortage occupation catalogue is organised geographically and updated quarterly. Check the edition relevant to the application.
A listing facilitates the immigration procedure; it does not replace the remaining requirements.
Where an exemption is claimed, include evidence supporting it. Nationality, family circumstances or the nature of the appointment may matter, depending on the legal basis.
Documents for the Employer’s Application
The ordinary application uses EX-03.
The supporting file commonly includes:
- The worker’s complete valid passport copy.
- Evidence of required professional qualifications.
- The signed employment contract.
- Employer identification and representation documents.
- Evidence of resources supporting the proposed employment.
- Labour market documentation or evidence of an applicable exemption.
Match names, passport details, remuneration and workplace information across the documents.
Criminal record certificates and medical evidence also matter in the overall process, particularly at the visa stage. Keep the employer’s authorisation file and the consular checklist distinct.
Translation and Legalisation
Foreign public documents may require an apostille or diplomatic legalisation unless an exemption applies.
Documents must also meet the applicable translation requirements. A sworn translation is a commonly accepted route, but other officially recognised translations can be valid.
Check these formalities before ordering documents, especially where certificates have limited validity.
Filing, Fees and the Initial Decision
The employer or authorised representative submits the application to the competent authority for the workplace. The Ministry identifies Mercurio as an electronic submission channel.
Regional arrangements should be checked where an autonomous community exercises transferred powers.
Residence and work fees are separate:
- Modelo 790, código 052: the applicable residence fee is payable by the worker.
- Modelo 790, código 062: the applicable initial work fee is payable by the employer where the authorisation lasts at least six months.
Select the correct fee category and retain payment evidence. Visa and TIE fees are additional.
The ordinary initial authorisation has a three-month decision period. If the applicable period expires without notification, the initial application can be treated as rejected through administrative silence.
Check the case history, including any suspension of the deadline, before calculating the result. An unanswered initial application does not authorise work.
Our guide to residence permit delays and administrative silence explains why the procedure matters.
Applying for the Employee Visa
After approval, the visa application must be submitted within one month of notification of the authorisation grant to the employer.
Apply through the Spanish consular office competent for your place of residence. This is not necessarily your country of nationality.
Prepare the current local checklist, including the authorisation, passport, application documents, relevant criminal record certificates, medical certificate and visa fee.
Appointment arrangements, certificate requirements and document presentation can differ between consular offices.
Coordinate the employer’s notification date with the worker’s preparations so the visa deadline is not missed.
Arrival and Social Security Registration
Enter Spain within the validity and entry conditions of your visa.
For the ordinary initial route described here, Social Security registration must take place within three months of legal entry. The authorisation’s effectiveness depends on that registration.
The employer must arrange the required registration before employment begins. The immigration deadline is not permission to work unregistered during the first three months.
Keep evidence of entry, the approval and the Social Security registration together.
Getting Your TIE
For an initial authorisation lasting more than six months, apply for the TIE within one month of Social Security registration.
This card procedure is separate from the employer’s EX-03 application.
The police identify EX-17 and Modelo 790, código 012 for the residence card procedure. Follow the appointment instructions for the remaining supporting documents.
The TIE documents your immigration status. Its production does not replace the underlying authorisation or the Social Security requirements.
Check the card’s details and expiry date when you collect it.
Duration and Work Restrictions
An initial authorisation follows the duration of the proposed activity, up to one year.
Employment is normally limited to a particular occupation and autonomous community, with applicable exceptions. Read the resolution before accepting work outside its scope.
Can You Change Employer?
During the first year, a change in the same occupation is permitted after three months of validity. Earlier changes can qualify in specified circumstances.
The new employer must communicate the change. Changes in occupation or geographical scope may require a different procedure.
Can You Also Be Self-Employed?
The initial permit can also authorise self-employment while employment remains the main activity.
An exception applies if employment ends unexpectedly for reasons beyond your control; notify the Immigration Office within three days.
Assess the conditions and complete the separate tax and Social Security registrations before starting.
Renewing the Employee Residence Permit
Renewal is assessed under its own rules.
Potential qualifying situations include continued employment, specified employment-history and new-contract circumstances, unemployment benefits and other statutory grounds.
There is no universal rule requiring every applicant to have worked six months. Identify the relevant renewal basis and prepare evidence supporting it.
Application Window
Apply during the two months before expiry.
An application can also be submitted within the following three months, although late filing may lead to a sanction. Filing within the recognised windows extends the previous authorisation while the application is decided.
The ordinary renewal procedure has a three-month decision period and positive administrative silence, subject to checking the applicable deadline and case history.
Duration of the Renewal
Renewal is generally for four years, unless long-term residence is appropriate. It permits employment and self-employment throughout Spain.
An initial permit lasting less than a year has a specific renewal rule: the activity’s duration, up to one year.
After renewal, complete the new TIE procedure. Our residence card renewal guide explains the distinction between the authorisation and physical card.
Frequently Asked Questions
Can a Job Offer During a Tourist Visit Give Me Work Rights?
A job offer does not itself authorise employment or replace the required immigration procedure. Check the appropriate route before relying on a tourist stay.
Does the Employer Submit My Renewal?
The ordinary renewal application is submitted by the worker, personally or through an authorised representative. Employer documents may support the relevant renewal basis.
Can a Part-Time Contract Support an Initial Application?
It may, but the specific salary requirement must be met. For this route, total remuneration must reach at least the annual full-time statutory minimum wage, alongside the other applicable requirements.
