Marriage and a Spanish civil partnership, usually called a pareja de hecho, can both be relevant to an international couple’s plans. However, their effects on residence, nationality and financial protection differ.

The choice depends on where you live, your nationalities, the evidence you can provide and the legal rights you want to establish. Formalising a relationship and applying for an immigration permit are separate procedures.

What is a civil partnership in Spain?

A pareja de hecho is a stable relationship between unmarried partners. Its recognition, registration requirements and legal effects depend on the applicable regional rules.

Some regional systems recognise a qualifying stable relationship without registration. Registration can nevertheless be important evidence for immigration or other purposes. It does not make the partners married.

Civil partnership vs marriage: key differences

IssueCivil partnershipMarriage
Marital statusPartners remain unmarriedCreates the legal status of spouses
FormalisationRegional rules, evidence and registration procedures varyRequires the applicable marriage procedure and legal capacity
Residence in SpainMay support a qualifying partner applicationMay support a qualifying spouse application
Nationality through a Spanish partnerNo special one-year residence reduction solely because of the partnershipA one-year residence period may apply if the marriage conditions are met
Joint Spanish IRPF returnPartners cannot file jointly as a coupleSpouses not legally separated can generally choose joint filing
Ending the relationshipRegional termination and registration-cancellation rules applyDivorce is required to dissolve a valid marriage during the spouses’ lives

Neither option automatically grants a residence permit or Spanish nationality.

Do partnership requirements vary by region?

Yes. There is no single nationwide registration checklist or universal minimum period of cohabitation.

RegionExamples of relevant rules
MadridTwelve months of uninterrupted joint registration at the same address immediately before the application, and residence in the Community of Madrid
CataloniaA stable partnership can arise through more than two years of uninterrupted cohabitation, a common child during cohabitation, or formalisation in a public deed
AndalusiaAt least one partner must habitually reside in Andalusia. The procedure allows a declaration of the intention to live together; it does not impose Madrid’s twelve-month rule

Other eligibility conditions still apply. In Catalonia, constituting a stable partnership and registering it are distinct steps.

Check the competent registry’s current requirements before ordering documents. Regional partnership rules do not replace the separate evidence requirements for an immigration application.

How to register a civil partnership

  1. Identify the competent registry. Check your address, eligibility and the rules applying to your relationship.
  2. Confirm the document checklist. This may include valid identity documents, civil-status certificates, proof of address and cohabitation, and evidence that previous marriages or partnerships have ended.
  3. Prepare foreign documents. Obtain apostilles or legalisation and official translations where required, taking account of applicable exemptions.
  4. Complete the required appearance or declaration. Follow the local procedure, including any notarial step, application form and fee.
  5. Obtain proof of registration. Keep the resolution and an updated certificate for any subsequent residence application.

A notarial deed does not automatically replace registration when the intended procedure requires a registered partnership.

How to get married in Spain

For a civil marriage, the preliminary expediente matrimonial or notarial act checks the couple’s capacity to marry and any legal impediments. It is separate from the wedding ceremony.

  1. Contact the competent Civil Registry or follow the relevant Notarial College’s assignment procedure.
  2. Prepare the requested documents. These commonly include identification, birth certificates, proof of address, and civil-status or marriage-capacity evidence. Divorced or widowed applicants may need additional certificates.
  3. Complete the required interviews, declarations and witness evidence.
  4. After authorisation, arrange the ceremony before a competent authority.
  5. Ensure the marriage is registered and obtain the marriage certificate.

Foreign nationals can marry in Spain if the applicable conditions are met. Document requirements depend on the case; a sworn declaration alone may not establish civil status.

The Andalusian Notarial College’s guidance explains its local assignment procedure. A town-hall wedding booking does not replace the preliminary marriage procedure.

Can marriage or a partnership help you obtain residence?

Potentially. Start with the sponsor’s nationality and residence status.

If your partner is Spanish

The residence route for family members of Spanish nationals can cover a qualifying non-EU spouse, registered partner or duly proven stable partner.

For the registered-partner category, Article 94 refers to a qualifying public register in an EU or EEA state or Switzerland, with the registration still active.

For an unregistered stable partnership, at least twelve continuous months of marriage-like cohabitation, inside or outside Spain, establish the specified evidence standard. The prior-cohabitation period is not required where the couple has common children and the relationship continues.

The family relationship, cohabitation and other application requirements must still be established.

If your partner is another EU, EEA or Swiss citizen

The EU family residence framework can cover spouses and qualifying registered partners. A duly proven durable partner may also qualify under the extended-family provisions.

The EU citizen must meet the applicable residence conditions. Our EU family member card service explains the assistance available.

If your partner is a non-EU resident

Under ordinary family reunification, spouses and qualifying partners may apply subject to the sponsor’s residence status, resources, housing and other requirements.

Special permits, including international teleworking residence under Law 14/2013, have their own family procedures. Do not assume every non-EU resident uses ordinary family reunification.

Our guide to moving to Spain with a non-EU partner compares the main routes.

Does marriage offer a shorter route to Spanish nationality?

Marriage to a Spanish citizen may reduce the required residence period to one year. At the time of application, you must also have been married to that Spanish citizen for at least one year and not be separated legally or in fact.

The residence must be legal, continuous and immediately before the application. Good civic conduct and sufficient integration are also required.

A pareja de hecho does not provide this marriage-based reduction. Another reduced period may apply independently to your circumstances.

Our Spanish citizenship service explains how we assess eligibility. The wedding itself does not grant citizenship.

What about tax, inheritance, pensions and work?

Income tax

Under the ordinary Spanish IRPF framework, spouses who are not legally separated can generally choose joint filing. Whether it is financially beneficial requires a calculation.

Unmarried partners cannot file jointly as a couple. Where they have qualifying children, one parent may form a tax family unit with those children; the other partner files individually.

Inheritance

An unmarried partner does not have the same statutory inheritance position as a spouse under Spain’s common Civil Code. However, regional civil laws can recognise inheritance rights for stable partners, including under Catalan succession law.

For international couples, the applicable succession law must also be checked. Registration alone should not be treated as complete estate planning.

Widow’s or widower’s pension

Both spouses and qualifying unmarried partners can be eligible, subject to Social Security requirements. Neither marriage nor registration guarantees a pension.

For unmarried partners, Article 221 includes formalisation and cohabitation conditions. These are separate from the regional requirements for registering the partnership.

Paid leave

For employees covered by the Workers’ Statute, Article 37 provides fifteen calendar days of paid leave for marriage or registration of a pareja de hecho, subject to notice and justification.

Which option is more suitable for you?

Compare the options against your actual situation:

  • Can you meet the local partnership requirements now?
  • Which immigration route applies to your partner’s status?
  • Is the marriage-based nationality reduction relevant?
  • What financial and inheritance protection do you need?
  • Will the relationship need recognition in another country?

There is no universal fastest option. Appointment availability, foreign documents and the residence procedure can all affect timing and cost.

Frequently asked questions

Is a civil partnership always faster or cheaper?

No. Registration requirements, waiting times, notarial involvement and document costs vary. Compare the complete process for your location and circumstances.

Do we need to marry to apply as partners of a Spanish citizen?

Not necessarily. Qualifying registered partners and duly proven stable partners can also use the relevant residence route. The relationship must satisfy the category’s requirements.

What happens to residence if the relationship ends?

Check your permit’s rules promptly. Divorce, separation or partnership cancellation can trigger notification duties and affect eligibility. Continuing or independent residence depends on the applicable route and conditions.
