1. What is the EU Family Card?

The EU family member card is a permit for non-EU foreigners who are family members of a European Union citizen and who wish to reside in Spain for more than 3 months. The initial permit has a duration of up to 5 years. It must be requested at the Immigration Office of the province in which the person concerned is registered. It is not possible to apply for it while outside Spain.

3.1. More information in regards to the proof of the family bond

From our point of view, the documentation proving the family relationship is, together with the proof of economic sufficiency, the central element in the application process for the Community Family Card. 

It is very important to be careful with marriages not celebrated in Spain or any other EU member state, since it is possible that the marriage will have to be registered  in order to successfully process the EU family member card.

3.1.1 Is it necessary to register the marriage in Spain to apply for the EU Family Card?

If you got married in a non-EU country, you may have to register the marriage in Spain (or in another EU country) before you can apply for the EU Family Card. But what does it depend on? Well, it depends on the legal system of the country where the EU citizen comes from. If the EU citizen comes from a member country that recognizes foreign marriages without the need for prior registration, Spain will accept this regulation and it will not be necessary to register the marriage either in Spain or in another EU member country.

However, if the EU citizen comes from a member country that does not recognize foreign marriages without prior registration of the marriage, it will not be possible to apply for the EU family member card until the marriage is registered.

3.1.4. Is it possible to apply for the Community Family Card without being married or registered as partners?

Yes, it is possible to apply for the EU family member card by proving the existence of a stable non-registered partnership. Here it will be necessary to use a series of documents that will have to demonstrate the existence of this bond.

3.2. More information in regards to the proof of financial sufficiency

As stated above, a successful application for a EU Family Card requires proof of sufficient financial means. This, essentially, can be done in the following ways:

  • The EU citizen is an employee in Spain. In this case we can provide the signed employment contract and the employment history report (informe de vida laboral).  
  • The EU citizen is self-employed. In this case we can provide the Social Security affiliation document or the Registration in the census of economic activities.
  • Sufficient savings are accredited. The specific amount to be credited varies according to the applicant’s circumstances. In the case of a family unit of 2 persons (i.e. the EU citizen and the non-EU citizen) it is usually sufficient to prove the existence of savings of €8,000 (year 2023).  It is also important to note that it will be necessary to take out private medical insurance with no co-payments, no waiting periods and coverage equivalent to that provided by the Spanish national health system.

4. How to apply for the EU Family Card?

The EU Family Card can only be applied for from Spain (it is not possible to apply for it from abroad through a Spanish Consulate).

Which is the competent body?

The Immigration Office of the province where you are registered. 

How long does it take to issue a decision?

3 months from the day after the corresponding file is received by the competent Immigration Office. In some provinces it is common to experience delays in the processing.

5. How to apply for the Residence Card (TIE)?

You have finally reached the finishing straight. The migratory journey is almost over. Once you have your residence card, you will be able to reside in Spain for the duration of your permit. What do you have to do to get it?

Step 1: Make an appointment

You must first request an appointment for the fingerprinting*. Due to its scarcity it can be a difficult task. Be patient. We will be at your disposal if you need help.

Step 2: Collect the documents

In order to apply for a residence card (TIE) it is important that you prepare the necessary documentation. More information below.

Step 3: The fingerprinting

On the day of the appointment you must present the corresponding documentation and your fingerprints will be taken.

Step 4: Pick up the card

After 30 to 40 days after the fingerprinting you will be able to pick up the residence card. For this you will again need an appointment.

6. Can EU Family Card holders work in Spain?

Yes, EU Family Card holders may be employed or self-employed under the same circumstances as Spanish nationals.
