Visa Denial in Spain: Appeal Deadlines and Steps in 2026

A visa denial in Spain needs a prompt, organised response. Start with the written decision, identify why the application was refused and record when you received the notification.

For a refusal issued by a Spanish consulate, the usual options are an administrative reconsideration appeal, known as a recurso potestativo de reposición, or judicial review through a recurso contencioso-administrativo. A new application may also be appropriate, depending on the reason for refusal.

The right choice depends on the decision, the available evidence and the applicable deadlines.

First, identify exactly what was refused

This guide focuses on visa refusals issued by Spanish consulates. A residence-authorisation refusal issued within Spain, including a UGE decision, may have a different appeal route.

This distinction matters for applicants using the Digital Nomad Visa route: a consular visa application and a residence application submitted in Spain are separate procedures.

Read the appeal instructions at the end of your decision. If the notice covers both a visa and an underlying residence or study authorisation, check whether both decisions need to be challenged.

Spain’s immigration regulation requires visa-refusal notifications to identify the available remedy, the competent authority and the filing deadline.

A request for additional documents is a separate procedural step. If you have received a document request rather than a refusal, respond through the specified channel within the deadline given.

Why was your Spanish visa refused?

Build the response around the actual grounds in your notice.

Issue identified in the refusalEvidence to examine
Financial evidence is insufficient or unclearAccount ownership, available funds, income records and the requirement for your visa category
Documents or personal details are inconsistentNames, dates, passport details, certificates, translations and explanations of discrepancies
The purpose or conditions of the stay are not establishedTravel plans, accommodation, admission documents or employment evidence, as applicable
For a short-stay visa, the intention to leave is questionedEmployment, family responsibilities, residence and other relevant ties outside the Schengen area

These are review examples, not a universal document checklist. Short-stay visas and national visas have different eligibility rules.

Allegations involving document authenticity, an entry ban or security concerns need a response to that specific finding; adding more bank statements will not address it.

Spain visa appeal deadlines

For the usual consular refusal procedure, the key deadlines are:

OptionGeneral filing deadlineStarting point
Administrative reconsideration: recurso de reposiciónOne monthThe day after notification of the visa refusal
Direct judicial reviewTwo monthsThe day after notification of the visa refusal
Judicial review after an express rejection of reconsiderationTwo monthsThe day after notification of that rejection

These periods are reflected in the Spanish consulate’s official appeal guidance.

An administrative deadline of one month does not mean 30 working days. Month-based calculation and non-working-day rules must be checked. Court deadlines follow their own procedural rules.

Keep evidence of notification, such as the delivery receipt or electronic record. The date printed on the decision may differ from the date on which notification took effect.

Requesting clarification or arranging a consultation does not itself preserve an appeal deadline.

How an administrative reconsideration appeal works

A recurso de reposición asks the authority that issued the refusal to reconsider its decision. Under Articles 123 and 124 of Ley 39/2015, this remedy is optional where available.

Prepare a signed submission that identifies:

  • The applicant, passport details and application reference.
  • The decision being challenged and its notification date.
  • Each disputed refusal ground.
  • The facts, legal arguments and supporting documents.
  • The outcome requested.

Write the appeal in Spanish and check the consulate’s filing instructions. For example, the New York consulate directs applicants to submit reconsideration appeals through its designated visa application centre.

Keep the filing receipt and a complete copy of the submission.

What if the consulate does not answer?

The statutory period for deciding and notifying a reconsideration appeal is generally one month, subject to applicable procedural rules.

If the relevant period expires without a notified decision, the appeal can generally be treated as rejected by negative administrative silence, opening the judicial route.

Silence does not mean that the visa has been approved.

Judicial time limits following negative silence require separate analysis. The Constitutional Court’s Judgment 52/2014 explains why challenging negative administrative silence is not subject to the expiry period in Article 46.1 in the same way as an express decision.

Have the position checked promptly, and continue monitoring notifications: a later express rejection can trigger a filing deadline.

How judicial review works

A recurso contencioso-administrativo challenges the refusal before a court.

You may normally go directly to judicial review where the refusal ends the administrative route. If you have already filed reconsideration, you must wait until it is expressly decided or the applicable negative-silence effect arises.

Official consular guidance commonly identifies the High Court of Justice of Madrid — Tribunal Superior de Justicia de Madrid for consular visa refusals. Confirm jurisdiction for the particular decision.

Proceedings before that court require a lawyer and a procurador, the professional responsible for procedural representation. The representation rules and express-decision deadlines appear in Ley 29/1998.

The claim should explain the legal or factual error and request the appropriate remedy. A favourable outcome can require a new decision or further processing; it does not always mean immediate visa issuance.

What documents should you prepare?

Use this as a starting checklist for reviewing the case:

DocumentWhy it matters
Complete refusal noticeIdentifies the decision, grounds and appeal instructions
Evidence of notificationHelps establish the deadline
Passport and application referenceIdentifies the applicant and file
Original application and attachmentsShows what the authority had before it
Documents addressing each refusal groundSupports the specific challenge
Representation documents, where applicableEstablishes authority to act for the applicant

Organise attachments in a numbered index and refer to them in the appeal. Check whether translations, apostilles or legalisation are required for the documents concerned.

Do not assume every new document will be accepted. Article 118 of Ley 39/2015 restricts reliance on material that could have been provided during the original allegations stage but was not.

Distinguish evidence clarifying an existing entitlement from a change that only makes you eligible now. Our guide to Spanish bureaucracy for foreigners explains common documentation and administrative concepts.

Should you appeal or submit a new application?

An appeal may be appropriate where the authority overlooked submitted evidence, misunderstood the facts or applied the wrong legal requirement.

A new application may be more practical where your circumstances have changed or an eligibility requirement was genuinely unmet.

For example, if the refusal incorrectly assessed funds already documented in the original application, a challenge may be relevant. If sufficient funds became available only afterwards, a new application may better reflect the current position.

For Schengen visas, Article 21(9) of the Visa Code provides that an earlier refusal must not automatically cause a new application to be refused. The new application is assessed using the available information.

Address the earlier concerns and disclose previous refusals where requested. A new application does not restart the deadline for challenging the old decision.

How long will an appeal take, and what will it cost?

The statutory reconsideration period is different from a guaranteed practical turnaround. Court proceedings depend on the case and the court’s workload.

Before choosing a route, ask for a written scope of work and an estimate covering legal advice, representation and any necessary translations or document preparation.

Compare those costs with the strength of the challenge, the urgency of your plans and the suitability of a new application. No appeal has a guaranteed success rate.

Frequently asked questions

Can I stay or work in Spain while the appeal is pending?

A visa appeal does not itself grant entry, residence or work permission. Under Article 117 of Ley 39/2015, filing an appeal generally does not suspend the challenged decision.

If you are already in Spain, assess your existing immigration status and any necessary protective measures separately.

Do I need a lawyer for an administrative appeal?

You can generally submit reconsideration yourself. An immigration lawyer in Spain can help assess the grounds, evidence and strategy. Judicial proceedings have formal representation requirements.

Does a complaint to the visa centre count as an appeal?

A service complaint or informal email is not a substitute for a properly filed appeal. Follow the authorised procedure and retain proof of filing.
